Legal Texts Regarding Archives
Article (25) The relevant authority that transferred its archives to the authority may review or temporarily retrieve them whenever necessary, in accordance with the procedures specified by the regulations.Article (28) The period mentioned in Article (26) of this law is extended to one hundred years for the following archives:
The following archives:
- A. Archives and records of civil status related to birth.
- B. Archives containing information about individuals' professional and health lives.
The period is calculated from the individual's date of birth.
Anyone who accesses the archives due to their work is committed not to use them outside of their work context.
Within the scope permitted by the provisions of this law and the regulation.
Any person may access and benefit from the archives after at least thirty years have passed from the date of their creation or acquisition by the concerned authority.
The provisions of Articles (26), (27), and (28) of this law shall be exempted in the following cases:
A. The archives may be accessed once access to them is legally permitted.
B. The head of the authority may allow access to the archives for reasons related to the public interest or
for the requirements of scientific research, provided that the authority that created these archives agrees, while taking into account
the protection of the confidentiality of personal life or national security and its safety.
C. Anyone with a legitimate interest may obtain certified copies and contents of the archives
pertaining to them, and these copies and contents shall have the same legal value as the originals. The certification
shall be done by the head of the authority or someone authorized by them, for a fee set by the authority and issued by a decision
from the minister, after the approval of the Ministry of Finance.
The duration mentioned in Article (26) of this law is extended.
The law extends the duration mentioned in Article (26) to sixty years for the following records:
B. Records related to investigations, statistics, and any other records containing information about individuals' actions, behaviors, and affecting their personal and family lives.
C. Records related to cases brought before the judiciary that pertain to individuals' personal or family life, with the mentioned duration starting from the date of the final decision or judgment in the case or from the date the file is permanently closed.
D. Records related to civil status data and registers concerning marriage, divorce, and death. Article
- Any person who is permitted to view the archives in accordance with the provisions of this
- law may obtain copies, images or contents of these archives at his own expense in return for a
- fee determined by the Authority and issued by a decision of the Minister after the approval of the Ministry of Finance. He may not use
- what he obtains for commercial purposes except after obtaining a written license to do so from the Authority.
